Welcome to Unrot, an application owned by Sophinity Tecnologia Ltda. ('Sophinity', 'we', 'our'). By creating an account or using Unrot, you ('User', 'you') agree to these Terms of Use.

1. Acceptance: By accessing or using Unrot, you confirm that you have read, understood, and agree to be bound by these Terms of Use, the Privacy Policy, and any other rules that may be disclosed in the application.

2. Definitions:

   • 'Application' or 'Unrot': digital platform that offers a feed of entrance exam questions in short video format.

   • 'User Content': any text, image, audio, video, notebook photograph, book, or other material submitted, transmitted, or displayed by you in the Application.

   • 'Services': all functionalities provided by Sophinity through Unrot.

3. Eligibility:

    3.1. The use of Unrot is permitted for individuals from 13 (thirteen) years of age.
    3.2. Users under 18 (eighteen) years declare that they have read these Terms along with their parents or legal guardians, who: (i) formally consent to the use of Unrot; (ii) commit to supervising the account, which includes periodically checking the content posted, activating available parental controls, and keeping contact details updated; and (iii) assume full responsibility for any actions taken by the minor within the Application.

    3.3. Children under 12 (twelve) years old should not create an account or use Unrot without the specific and highlighted consent of their parents or guardians, as per art. 14 of the LGPD.

4. Account Registration: You must provide true, complete, and updated information, including the school you attend, and maintain the security of your account. Sophinity may suspend or terminate accounts that violate these Terms.

5. License to Use the Application: We grant you a personal, limited, non-exclusive, revocable, and non-transferable license to use Unrot in accordance with these Terms.

6. User Content:

    6.1. Representations and warranties:
     a) You represent that you own all necessary rights or have authorization to publish the User Content.
     b) You are solely responsible for the User Content you provide; Sophinity is not responsible for copyright infringements or third-party claims.
    6.2. Grant of License:
    By submitting User Content, you grant Sophinity a worldwide, free, non-exclusive license, for the entire term of legal protection, to use, reproduce, distribute, publicly display, modify, adapt, create derivative works, translate, and incorporate such content into Unrot, including for the purposes of:
     (i) operation and improvement of the Application and its algorithms;
     (ii) publicity, marketing, and promotion of Unrot;
     (iii) research and development of new products and services.
    6.3. Monitoring, Notification, and Removal:
    Sophinity may, but is not obligated to, monitor, review, or remove User Content at any time, without notice, if it believes that it violates these Terms or applicable law. If any third party notifies of an alleged copyright infringement, we will make available a 'notice and takedown' procedure, in accordance with art. 19 of the Internet Civil Framework. Upon receiving a court order or valid notification, we will promptly and diligently remove the indicated content, without such removal implying prior assumption of liability for the material published by the User.

7. Prohibited Conduct:

   The User is prohibited from:
    a) Submitting Content that infringes on third-party rights, including copyright and image rights;
    b) Publishing violent, sexually explicit, discriminatory, illegal, or offensive material;
    c) Reverse engineering, interfering with the operation of the Application, or accessing private areas without authorization;
    d) Using Unrot for commercial purposes without prior authorization from Sophinity.

8. Intellectual Property Rights: All software, design, trademarks, logos, and other content of Unrot belong to Sophinity or its licensors and are protected by Brazilian and international law.

   
   

9. Disclaimer of Warranties: Unrot is provided 'as is.' We do not guarantee that the Services will be free of errors, interruptions, or safe from data loss.

10. Limitation of Liability: To the maximum extent permitted by law, Sophinity shall not be liable for indirect damages, loss of profits, or loss of data arising from the use or inability to use Unrot.

11. Modifications of Terms: Sophinity may amend these Terms. Substantial changes will be communicated by notice in the Application or by email. Continued use after the changes take effect constitutes acceptance.

12. Monetization and Payments: Sophinity may, at its sole discretion, implement revenue-generating mechanisms in Unrot in the future, including but not limited to:

     (i) displaying contextual or personalized advertising;

     (ii) selling subscriptions, virtual credits, or in-app purchases;

     (iii) revenue-sharing programs with content creators.

    The User acknowledges and agrees that, when such models are launched, additional terms, policies, or contracts may be established, which will be presented for prior acceptance. If the User continues to use Unrot after the availability of such monetization models, such use will constitute acceptance of the corresponding specific terms.

13. Arbitration and Dispute Resolution: Any and all controversies arising from these Terms shall be definitively resolved by arbitration administered by the Chamber of Mediation and Business Arbitration – Brazil (CAMARB), according to its Regulations, headquartered in Rio de Janeiro, RJ, by one (1) arbitrator mutually appointed. The procedure will be conducted in the Portuguese language, and the arbitral award will be final and binding, enforceable in any competent court. Claims that fall within the limits of the Special Civil Court may be filed directly in that forum, at the claimant's choice.

14. Force Majeure: Sophinity shall not be liable for delays or failures in fulfilling obligations resulting from events beyond its reasonable control, including but not limited to acts of God, acts of war, terrorism, strikes, civil disturbances, power failures, natural disasters, pandemics, DDoS attacks, or interruptions of telecommunications services.

15. Electronic Communications: You agree to receive electronic communications from Sophinity (emails, push notifications, or in-app messages) related to Unrot and acknowledge that such communications satisfy any legal requirements for written form.

16. SMS Message Services: If you provide a mobile phone number, you authorize the sending of SMS by Sophinity for: (i) account verification; (ii) security alerts; and (iii) non-promotional operational information about the service. You may opt-out of receiving SMS at any time by responding 'STOP' or following the instructions in the message itself. Charges from your carrier may apply. Sophinity is not responsible for delays, delivery failures, or third-party charges.

17. Beta Features: The User acknowledges that Unrot is currently in Beta phase. Beta features may exhibit instabilities, be modified, or discontinued at any time without prior notice and without any obligation of support, warranty, or compensation.

18. Third-Party Materials and Links: Unrot may contain content or links to third-party websites. Sophinity does not control, endorse, or assume any responsibility for such materials or external sites. Accessing and using third-party content is solely your responsibility.

19. Termination: We may suspend or terminate your account at any time in case of violation of these Terms.

20. General Provisions

     21.1. Applicable Law: These Terms are governed by the laws of the Federative Republic of Brazil.
     21.2. Jurisdiction: The jurisdiction of the City of Rio de Janeiro, RJ, is elected, waiving any other jurisdiction, however privileged it may be.

     21.3. If any provision is found to be invalid, the remaining provisions shall remain in full force.
